South Florida Journal of Development https://ojs.southfloridapublishing.com/ojs/index.php/jdev
The South Florida Journal of Development (SFJD) arose from the perception of some professors about the lack of means of disseminating the theme of development in scientific articles. It is a bimonthly publication whose objetive is to disseminate knowledge in the area of development by means of the publication of scientific articles that present original contributions, both empirical and theoretical.

Prof. Daniel Molina Botache, PhD, is editor-in-chief of the South Florida Journal of Development.

ISSN: 2675-5459

SFJD DOI prefix: 10.46932

H Index Median (Google Metrics) - 10
Jorge Armando Gutiérrez Valencia Reyna Valladares Anguiano Martha Eugenia Chávez González Raymundo Padilla Lozoya Francisco José Martín del Campo Saray Copyright (c) 2024 2024-04-04 2024-04-04 5 4 e3796 e3796 10.46932/sfjdv5n4-002 Conflicts Beyond Borders – Possibilities for International Alternative Conflict Resolution https://ojs.southfloridapublishing.com/ojs/index.php/jdev/article/view/3797
Mediation is one kind of procedures to solve a conflict. Mediation is based on the voluntary participation of the parties. Mediation is a voluntary process in which an impartial person (the mediator) helps with communication and promotes reconciliation between the parties which will allow them to reach a mutually acceptable agreement. It is a procedure, in which an intermediary without adjudicatory powers systematically facilitates communication between the parties with the aim of enabling the parties themselves to take responsibility for resolving their dispute. The procedure has the character of confidentiality and the neutrality. Mediation is a negotiation procedure facilitated by a neutral third-party who assists the parties in moving to resolution. The neutral third party has no control over the outcome of the case and conflict, but controls and directs the process itself, he or she is responsible for the procedure. While court proceedings are authoritative, formalised and claim-oriented, mediation offers a flexible, self-determined approach in which all aspects of the conflict -independent of their legal relevance- may be considered. Against this background, mediation -in contrast to court proceedings- is described as alternative dispute resolution (ADR). The question is: to solve the conflict and find a solution or to transform a conflict and reshape the connection between the parties? What is the matter when the mediation process has to be conducted between parties, who live in different countries or when one person of the parents just want to go abroad with the common child or children. How can cross-border mediation help? This publication tries to show a possible answer.
Mizser Csilla Ilona Copyright (c) 2024 2024-04-04 2024-04-04 5 4 e3797 e3797 10.46932/sfjdv5n4-003 Environmental legislation and policy: from national to municipal https://ojs.southfloridapublishing.com/ojs/index.php/jdev/article/view/3804
The elaboration of the research project consisted in tracing a brief history of Brazilian environmental legislation since the colonial period, in presenting the nuances of the Constitutional chronology of Environmental Law in Brazil, in listing the laws that provide for National Policies aimed at the national environment. , in criticizing the judicial and administrative flexibility of environmental rules, in presenting the teleological bias to the dismantling of the state apparatus of environmental defense, as well as the reflexes of the institution of National Policies in the municipal legal system with a focus on the Municipality of Valença-Ba. Finally, the understanding of the reflexes of the National Environmental Policy in the Legal Order of Brazilian Municipalities was critically concluded.
Juliano dos Santos Lago Copyright (c) 2024 2024-04-10 2024-04-10 5 4 e3804 e3804 10.46932/sfjdv5n4-004
